The Equal Employment Opportunity Commission's long-awaited proposed regulations issued on April 20 not only clarify the application of the Americans with Disabilities Act (ADA) to wellness-based programs—in particular, when incentive-based programs are considered "voluntary"—but also address the intersection between HIPAA's nondiscrimination rules and the ADA. Not all provisions will apply to all wellness programs.
