5 Pitfalls of Nondiscrimination Testing – and How to Avoid Them

Cafeteria plans, medical plans (including health FSAs), DCAPs and other benefit programs enjoy favorable tax treatment under the Internal Revenue Code. The Code’s nondiscrimination rules were designed to ensure that plans don’t favor individuals who are “highly compensated” or otherwise considered “key” to the plan sponsor.
